Justice Served: 42 Years Later, Fugitive Caught After Skipping Sentencing for Yonkers Robbery
In a significant development, a fugitive who had been on the run for over four decades was finally brought to justice.
Juan Hernandez, who disappeared in 1982 after being convicted of robbery in Yonkers, New York, was apprehended in July 2023.
His capture marks the end of a long search by law enforcement to close a case that has remained unresolved for 42 years.
Hernandez’s Disappearance and Return to the United States
After the 1982 conviction, Hernandez reportedly fled to his homeland, Nicaragua, eluding the authorities. His whereabouts remained a mystery until late 2022 when he re-entered the United States.
Hernandez was detained briefly in El Paso, Texas, in December 2022, but federal agents failed to check for an active warrant related to his robbery conviction. This oversight, coupled with an overcrowded prison, resulted in his release from custody.
Law Enforcement Takes Action
In February 2023, the Department of Homeland Security contacted Westchester County officials to confirm if Hernandez’s warrant was still active. Once they verified the warrant’s validity, the county’s Warrant-Fugitive Unit partnered with federal agents to locate the fugitive.
After intensive efforts, the authorities successfully apprehended Hernandez on July 9, 2023, in Miami, Florida, through a coordinated effort by the U.S. Marshal’s Fugitive Task Force.
Legal Challenges and Extradition
Upon his arrest, Hernandez attempted to resist extradition to New York. This prompted the Westchester District Attorney’s Office to secure a governor’s warrant.
In late September, county warrant squad detectives served Hernandez with this legal document and safely transported him back to Westchester County.

During a recent court hearing, Assistant District Attorney John Thomas addressed the court but refrained from requesting immediate imprisonment for Hernandez.

Ferrante mentioned that he has reviewed the sentencing minutes but is still waiting for critical details to understand why Hernandez did not serve his original sentence, where he was during these years, and what actions he took while evading capture.
Ferrante stated, “This case is over 40 years old, so we’re going to take some time to review the case, review the circumstances, and go from there.”
