Federal Jury Convicts Kay Flock, Rapper Faces Life Sentence in RICO Case
Bronx drill rapper Kay Flock, born Kevin Perez, has been found guilty on multiple charges in his federal RICO trial, Inner City Press reports.
After two days of deliberations, a New York jury convicted Kay Flock on Thursday (March 20) of racketeering conspiracy, use of a firearm resulting in death, attempted murder, assault with a dangerous weapon in aid of racketeering, and use of a firearm for attempted murder. However, he was acquitted of murder in aid of racketeering for the 2021 shooting of Oscar Hernandez outside a Harlem barbershop.
Flock, who was arrested in December 2021, now faces a potential life sentence, with sentencing scheduled for July 16.
The trial, which began on March 10, included testimony from multiple witnesses, including cooperating witness Vance Brockington, who alleged that Flock retaliated for him after he was shot by a rival gang. Brockington claimed Flock FaceTimed him from the hospital before carrying out a shooting. Prosecutors also leaned heavily on the rapper’s lyrics and music videos, arguing they were evidence of real-life gang activity.

The defense pushed back, insisting Flock was being targeted for his music rather than any actual crimes. His attorney framed the case as an attack on drill music, stating in closing arguments, “This case is U.S. versus drill rap.”
Flock was originally charged in the 2021 murder of Hernandez, with his legal team arguing self-defense. Surveillance footage allegedly shows Hernandez approaching Flock before the fatal shooting.
In February 2023, federal prosecutors escalated the case, linking him to the Sev Side/DOA gang and accusing him of multiple shootings in the Bronx between 2020 and 2022.
